Refund and Cancellation Policy

This Refund and Cancellation Policy (“Policy”) is drafted in compliance with the Information Technology Act, 2000, applicable rules thereunder, and relevant GST laws of India. This Policy governs refunds, cancellations, and service usage for DeWin Cloud (“DeWin”, “we”, “our”, or “us”). By accessing or purchasing our services, you agree to be bound by this Policy.

1. Scope & Legal Compliance

This Policy applies to all services offered by DeWin Cloud, including but not limited to:

• Managed Cloud & Infrastructure Services
• VPS / Cloud VPS
• Dedicated Servers
• Email, Security & IT Services

All transactions are subject to Indian laws, including the IT Act, 2000, Consumer Protection Act, 2019, and applicable GST regulations.

2. 7-Day Trial / Free Access (If Applicable)

Some services may include a 7-day free or trial access, where explicitly mentioned:

• Trial services are provided on an “as-is” and “as-available” basis
• No refund obligation arises after conversion to a paid plan
• DeWin reserves the right to limit features or suspend trials without prior notice

3. Cancellation Policy

3.1 Customer-Initiated Cancellation

• Customers may request cancellation by submitting a support ticket or written email request
• Cancellation must be requested before the next billing cycle
• Services will remain active until the end of the paid billing period

3.2 Termination

DeWin may suspend or terminate services immediately in case of:

• Violation of Terms of Service (TOS) or Acceptable Use Policy (AUP)
• Non-payment, fraudulent transactions, or chargebacks
• Activities prohibited under Indian law

No refund shall be applicable in such cases.

4. Refund Policy

4.1 General Refund Conditions

Refunds, if applicable, shall:

• Be considered only upon written request
• Be processed after internal verification
• Be issued to the original payment method only
• Be exclusive of GST, taxes, transaction fees, or bank charges

As per GST law, GST once invoiced and deposited with the government is non-refundable.

4.2 Non-Refundable Services

The following services are non-refundable:

• VPS, Cloud VPS, Dedicated Servers
• Cloud Infrastructure & Third-party Cloud (AWS, Google Cloud, etc.)
• Domain registrations, licenses, IP allocations
• One-time setup, installation, or customization charges

5. Abuse, Misuse & Policy Violations

If any service is found to be used for:

• Spam, hacking, malware, or illegal activities
• Excessive or abusive resource usage
• Any activity violating Indian cyber laws

DeWin reserves the right to terminate services without refund and report such activity to appropriate authorities if required by law.

6. Billing, GST & Invoicing

• All prices are exclusive of GST unless stated otherwise
• GST invoices will be issued as per Indian regulations
• No refund or credit shall be issued against valid GST invoices once filed

7. Policy Modifications

DeWin Cloud reserves the right to amend this Policy at any time. Updates will be published on the website and shall be effective immediately.

8. Governing Law & Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts located in India.
